EVERYONE HAS THE FOLLOWING RIGHTS

 

Right to refuse consent - for immigration or the police to search yourself, your car or your home.

Right to remain silent -  if you want to exercise that right, you should say it out loud.

Right to an attorney - before answering any questions, you may say, “I will remain silent until I speak to an attorney.”

Right to copies - of all immigration papers

Right to refuse signature - you do not have to sign anything you do not understand

Right to call the consulate - immigration enforcement must let the consulate of your home country visit or speak with you.

ICE ENCOUNTERS

The following reminders are provided in case you or a loved one encounters Immigration & Customs Enforcement (ICE):

 

(1) Stay calm

(2) Stay silent (don’t mention where you were born or how you entered the US)

(3) Record all details and names

(4) Do NOT run away

(5) Ask to speak to your lawyer before signing any documents or answering any questions

(6) If you do speak, do not lie.

Consider downloading the App and using the cards below for additional support during an ICE encounter. 

How to Use a Cards & App

Both the cards and the app can tell an officer you are exercising your right to remain silent. 

If approached by an officer in public and questioned, ask if you can remove the card from your wallet and show it to the officer.

If an officer approaches your home, slide the card under the front door, play the app through the door or a window. 

Download the KYR App

This Know Your Rights app, from NAKASEC, can read your rights out loud to an ICE or law enforcement agent and send a message to an emergency contact. 

The app is available in 16 languages (primarily Asian, but includes Spanish Haitian Creole, and Russian), and includes other resources, such as the ability to look up a consulate and a sample family preparedness plan.
